  1. Introduction

These Terms and Conditions govern the use of services offered by Expediciones Morrocoy, in accordance with the laws of the Bolivarian Republic of Venezuela and other applicable laws. By using our services, you fully accept these terms

2. Website Use

2.1 By using our website, you fully accept these terms.
2.2 Use of the website by minors is prohibited without the supervision of a responsible adult.
2.3 You agree not to use the site for illegal or unauthorized purposes.
2.4 We reserve the right to modify, suspend, or discontinue any aspect of the site at any time.

3. Reservations and Payments

3.1 Payments will be made according to the conditions specified in each reservation.
3.2 We reserve the right to modify prices at any time before reservation confirmation.
3.3 All rates are in US dollars (USD) unless otherwise specified.
3.4 Full payment must be made at the time of booking unless otherwise agreed in writing.

4. Cancellations and Refunds

4.1 Cancellations must be made in writing and sent to the email address provided on our website.
4.2 Refunds will be processed as follows:

  • Cancellation 30 days or more in advance: 90% refund
  • Cancellation between 15 and 29 days before: 50% refund
  • Cancellation less than 15 days: no refund
    4.3 The maximum refund under any circumstances will be 90% of the amount paid.
    4.4 Refunds will be processed within 30 business days following the cancellation request.
    4.5 No refunds will be given for unused services or cancellations during the trip.

5. Contracargos

5.1 Contracargos will be thoroughly investigated.
5.2 In case of fraudulent contracargo, we reserve the right to take legal action.
5.3 If a contracargo is initiated by the customer, all pending services will be suspended until the case is resolved.
5.4 The customer will be responsible for all costs associated with an unjustified contracargo, including bank fees and administrative costs.

6. Travel Insurance

6.1 We strongly recommend purchasing travel insurance that covers cancellations, medical emergencies, evacuation, and baggage loss.
6.2 Expediciones Morrocoy is not responsible for expenses arising from events not covered by the traveler's insurance.
6.3 It is the customer's responsibility to ensure that their insurance policy is adequate for the type of trip contracted.

7. Limitation of Liability

7.1 Our liability is limited to the cost of the contracted services.
7.2 We are not responsible for events beyond our reasonable control, including but not limited to: natural disasters, acts of terrorism, strikes, changes in government regulations.
7.3 We are not responsible for loss or damage to personal property during the trip.
7.4 Our liability for damages is limited to direct damages and will not exceed the total value of the contracted services.

8. Indemnification

8.1 The user agrees to indemnify Expediciones Morrocoy for any damage, loss, or expense resulting from misuse of our services.
8.2 This includes, but is not limited to, third-party claims, legal costs, and damage to reputation.

9. Warranty

9.1 We guarantee the provision of services described in the confirmed reservation, subject to the specified conditions.
9.2 We do not offer additional warranties beyond what is expressly stated in these terms.

10. Money Laundering Prevention

10.1 We reserve the right to reject suspicious transactions and report them to the competent authorities.
10.2 We may request additional information to verify the customer's identity and source of funds.
10.3 We adhere to all applicable anti-money laundering laws and regulations.

11. Force Majeure

11.1 We will not be responsible for non-compliance due to circumstances beyond our reasonable control.
11.2 This includes, but is not limited to: natural disasters, acts of war, terrorism, civil unrest, strikes, pandemics.
11.3 In case of force majeure, we will make all reasonable efforts to notify the customer and offer alternatives when possible.

12. Confidentiality

12.1 We are committed to maintaining the confidentiality of user personal information according to our Privacy Policy.
12.2 We will not share personal information with third parties except when necessary for the provision of contracted services or required by law.

13. Applicable Law and Jurisdiction

13.1 These terms are governed by the laws of the Bolivarian Republic of Venezuela.
13.2 Any dispute will be subject to the exclusive jurisdiction of the courts of Caracas, Venezuela.
13.3 Both parties expressly waive any other jurisdiction that may correspond to them.

14. Severability

14.1 If any provision of these terms is deemed invalid, the remaining provisions will remain in full force and effect.
14.2 The invalid provision will be replaced by a valid provision that comes as close as possible to the original intention.

15. Modifications

15.1 We reserve the right to modify these terms at any time.
15.2 Changes will take effect immediately after their publication on the website.
15.3 It is the user's responsibility to periodically review these terms to stay informed of any changes.

16. Claims

16.1 Any claim must be submitted in writing within 30 days following the end of the trip.
16.2 We commit to responding to all claims within 15 business days of receipt.

17. Scope of Work

17.1 Our services are limited to what is expressly stated in the description of the contracted trip or package.
17.2 Any additional service requested during the trip will be subject to availability and additional costs.
